HomeStayHoliday.com by HomeStayHoliday and its subsidiaries, including HomeStayHoliday websites around the world and secure areas of the websites (the “HomeStayHoliday Websites”). 10.1 The Word Travel Accommodation Ltd or The Company or HomeStayHoliday or WE ensure(s) the functioning of the website HomeStayHoliday as well as the other domains and sub-domains which bring the INTERNET USER or VISITOR or USER or YOU (natural person visiting the website) on this website or platform. By using this website, third parties who are either individuals or professionals can become there de facto as;

- Visitor (physical or moral person using the website) - also here mentioned as "visitor" or "traveller" or "user" (looking for an accommodation without being registered on the website),

- Member (physical or moral person using and registered on the website) - also here mentioned as "member" or " HomeStayHoliday ER" (who is looking for an accommodation and registered a profile on the website either as accommodation or advertiser),

- Subscriber (physical or moral person using, registered and having subscribed to a subscription plan as ACCOMMODATION on the website) - also here mentioned "host" or "announcer" or " HomeStayHoliday IN" (who is proposing an accommodation and receiving a traveller and registered a profile on the website as accommodation),

- Provider (physical or moral person using, registered and having subscribed to a subscription plan as ADVERTISER on the website - also here mentioned "provider" or "advertiser" or " HomeStayHoliday provider", (who is advertising their company and their services and registered a profile on the website as Advertiser),

10.2 INTERNET USER or VISITOR or USER or YOU (natural person visiting the website) do have the possibility to look for and to book an ACCOMMODATION through our website, without becoming a SUBSCRIBER and/or a PROVIDER and/or a SUBSCRIBER PROVIDER

10.3 INTERNET USER or VISITOR or USER or YOU (physical or moral person using the website) DO NOT have the possibility to announce online an ACCOMMODATION or to advertise as ADVERTISER, without becoming a SUBSCRIBER and/or a PROVIDER and/or a SUBSCRIBER PROVIDER

10.4 By using the website of the Word Travel Accommodation Ltd (www.HomeStayHoliday.com) the internet user admits to accept the conditions explained in the present declaration. Before an internet user can reserve an accommodation via the HomeStayHoliday website, it is imperative that this Internet user acquaints with these Terms of Use (Terms) and with the Privacy Policy (PP) and that he accepts them. He becomes legally bound by contract by ticking the checkbox provided for that purpose during the subscription procedure. 11. Accessibility

11.1 HomeStayHoliday and all its services are accessible 24 hours a day and 7 days a week. We will try hard within the limits of our possibilities, to limit the inconveniences caused to the users of the website without nevertheless having an obligation to reach that point. The HomeStayHoliday however reserves the right to operate a total, temporary and/or partial deactivation in case of major force (force majeure), technical problems or period of maintenance and cannot be considered as responsible of the consequences of these interruptions, as well towards the internet users as towards any third party and this, whatever is the cause, the duration and the frequency. Under no circumstances, these periods of deactivation can constitute a refund or an extension of the duration of publication of an announcement.

11.2 HomeStayHoliday could not be held responsible for none or bad functioning and/or the impossibility of access to its site, from bad conditions of use of the site ascribable to a none adapted equipment or for dysfunctions from the access provider of the internet user, from obstruction of the internet network or from any other external reason of the site, such as rate of transfer and time of answer during which the information’s circulates from the platform of HomeStayHoliday towards internet, which are not guaranteed by the site. The internet user recognizes that the transmission speed of information’s does not depend on the services offered by HomeStayHoliday, but on characteristics inherent to the electronic communications networks, from technical features of its mode of connection, and of its internet access.

11.3 HomeStayHoliday cannot guarantee that its site or the server which put it at the disposal of the internet user is free from virus or from other dangerous components. Any software and any data downloaded by the internet user, or obtained from any other way during the use of the HomeStayHoliday service, is at the own risk of the internet user who is the only responsible for any damage undergone by its computer or loss of data consecutive to the download of this software’s and data’s, or to the consultation and the use of the HomeStayHoliday services.

12. Use of the site

1. Extend of services

12.1.1 HomeStayHoliday is to put users in contact with each other, whether they are traveler’s accommodation users or hosts offering accommodation by indicating non-contractual accommodation’s information as well as on the organization, activities and values of accommodation and who publish their announcements of promotion of accommodations or services against the payment of a subscription for a minimum duration of ONE (1) MONTH and a maximum of ONE (1) YEAR.   

12.1.2 HomeStayHoliday is neither an intermediary nor a representative, but acts as an announcing site. Therefore, it is not legally bond to none general obligation of surveillance of the contents transmitted or stored via its site but HomeStayHoliday will make its best efforts to ensure that the information communicated via this site is truthful, accurate and update and reserve the right to modify the content at any time, as well as to remove any advertisements which would be fallacious, misleading or illusory, and this without any prior notice and without any refunding possible and any possibility of claim. However, HomeStayHoliday cannot guarantee that the information or news posted on the site is truthful and accurate, fully updated or exhaustive.

12.1.3 For this reason, the Word Travel Accommodation Ltd as well as its HomeStayHoliday website will never intervene in the exchanges between travellers and hosts and thus has no responsibility and no commitment toward the internet user, regarding the terms of the contracts passed between them, no more than to guarantee the validity of the conditions of rent in the announced accommodations.

12.1.4 HomeStayHoliday is authorized to develop its services, in particular by bringing to it any reduction, extension, improvement and any modification whatever the nature it is during the execution of its services.

2. Announcements and Announcers

12.2.1 The announcers have to be the owners of the accommodation which they announce, or to be representatives duly entitled to announce, to propose, to manage and to rent the property proposed on the website. In no one case, they can be representatives taking commissions on the reservations of the HomeStayHoliday members on owner’s behalf.

12.2.2 The announcers necessarily have to announce in the category on which they depend. Thus for example, hotel 5stars cannot announce in the category 2stars, Camping cannot announce in Glamping and so on. Thus, any advertisement published in the category which does not correspond to it in order to mislead the traveler and/or to subscribe at a lower cost, will be deactivated without prior notice and will not give the right to any refund nor possibility of claim.

12.2.3 HomeStayHoliday does propose only announcements of holiday’s accommodation and temporary stays and/or seasonal stays. So, any announcement published with the aim of renting its accommodation at the year or for selling it, will be deactivated without prior notice and will not give the right to any refunding nor possibility of claim.

12.2.4 The announcer cannot supply, in no one case, contradictory information’s with his announcement during a contacting. HomeStayHoliday can consequently carry out checks on the accommodation and/or about the identity of the owners, on IP addresses used by the owners, and require any necessary documentary evidences such as; proof of identity (for example: a photocopy of your ID card, your passport or your driving license), copies of the deed of property, copy of the mandate binding you to an owner if you are a voluntary representative, or quite any other documentary evidence allowing HomeStayHoliday to propose through its site, reliable announcements. The announcer acknowledges the existence and the right of HomeStayHoliday to carry out all these checks.

12.2.5 An announcement can propose only one accommodation: to register 2 accommodations, it is necessary to add a second announcement and so on. In no one case, the announcers can announce accommodation in the name of other hosts for accommodation of which they are not owners or representatives.

12.2.6 Announcements take place according to their recording. Consequently, the announcer cannot pursue HomeStayHoliday for a position of announcement that he would consider unfavorable.

12.2.7 HomeStayHoliday reserves the right to not publish an announcement and to remove at any time an announcement which would present an illicit character or not answering to legal requirements. In case of dispute between traveler and host, the announcer admits being in the obligation to supply precise explanations in order to justify this dissatisfaction. In case of non-answer or of insufficient justifications, HomeStayHoliday reserves the right to withdraw an announcement without prior notice and will not give the right to any refund nor possibility of claim.

12.2.8 The period of deactivation does not give the right to the prolongation or to the refund of the subscription, as well as in case of withdrawal before the end of validity of an announcement, months or remaining days, cannot be the object of any refund nor prolongation or any claim.

12.2.9 HomeStayHoliday can control contents of announcements within the limits of its possibilities, but cannot be held as responsible for the contents or for its absence or lack of contents. We can control texts, photos or the coherence of an announcement, and moreover multiply the checks of information’s by contacting an announcer by e-mail or by telephone to ask him for documents to make sure of the existence, the veracity, and the conformity of the information’s or of the accommodation. The announcer recognizes the existence and the right to HomeStayHoliday to operate all these controls.

12.2.10 By publishing an announcement on the HomeStayHoliday website, the announcer gives up to HomeStayHoliday, his rights of authors, of reproduction and of exploitation on all texts and photos relating to the announcement. HomeStayHoliday cannot be held as responsible for a fraudulent use of a text or of photography by an announcer. You can in case of violation of the rights of authors or violation of the private life, CONTACT US to ask for the withdrawal of the incriminated texts or photos.

12.3 Exclusion of a member /deletion of announcement

12.3.1 HomeStayHoliday, without depriving itself of any legal recourse, is entitled to limit or to interrupt your activity on its website, to immediately delete your announcement, to warn all visitors, members and subscribers, of your contrary actions to our rules, whether that it is temporarily or definitively.

12.3.2 HomeStayHoliday reserves the right to suspend your quality of registered member, subscriber, provider or subscriber provider and can refuse to supply to you any service and/or to withdraw any announcement, sponsorship or advertisement without prior notice. The suspension and/or withdraw will not give the right to any refund of subscription nor possibility of any claim, if:

a) You do not respect the present Terms of Use, Privacy Policy and Legal Notice,

b) We are in the incapacity to check information which you provide,

c) We consider that your activity can cause financial damage or from any others nature, for you, our visitors, members or subscribers, or for ourselves.

d) Your descriptions and photos are insufficient, false, or usurped, or not corresponding to reality

e) A traveler or a host commits regularly, systematically or in a repeated way, an absence of answer to information requests from members or subscribers or from us,

f) A dispute is in progress, and this, as soon as it is effectively brought indeed to our knowledge,

g) Your subscription plan is made in a category where your accommodation does not belong,

h) Your URL link or any other contact information is not leading the USER to your booking page and/or to the possibility to enter in contact with you in order to book your accommodation through direct negotiation with you as an announcer,

i) Rights of authors, of reproduction and of exploitation on all texts and photos relating to the announcement are not respected,

j) Your sponsorship subscription or your advertisement subscription is contrary to morality or shocking or belonging to one of the categories not authorized to be advertised on our website according to our non exhaustive list (pornography, politic, drugs and illicit substances, weapons, guns and rifles of all kinds, cigarettes, cigars and alcohol, pharmaceutical or medical, any profession related to laws).

HomeStayHoliday reserves the right to suspend and delete any announcement or advertisement that would be contrary to our commercial policy whether it is in the non-exhaustive list or not without this giving rise to a refund a claim.

12.3.3 TOTAL OR TEMPORARY exclusion does not give right to any refund of your subscription or to any possibility of claim. We can also decide to exclude you without having to justify ourselves. In this last case, the subscription is refunded to you in proportion to already used time.

12.4 Duration of publication of an announcement

The announcer has to subscribe to the category giving him right to the duration of publication. The publication of an announcement begins from the first day of the validation by HomeStayHoliday, after reception and validation of the payment of the chosen subscription formula. The publication period is fixed for the chosen period (1, 3 or 12 months). The publication will automatically come to an end the last day of the subscription taken out by the announcer. There is no tacit renewal. The announcer will be automatically informed of the expiration of its announcement and/or subscription, either redirected or invited for the renewal of his registration and/or subscription, seven days before and the last day before the expiration.

12.5 Getting in touch, Linking, Connecting remote individuals

12.5.1 HomeStayHoliday has for main objective to put in relation users (travellers) with subscribers (hosts). The getting in touch is carried out by all means wished and available by both parties according to information contact indicated by the host in its announcement.

12.5.2 HomeStayHoliday does not guarantee in any case a right of reply from a users (travellers) to a subscriber (hosts) or conversely. The announcers are free or not, to follow up the contacts established through HomeStayHoliday. However, we remind to our members and subscribers, the clause 12.3.2 paragraphs ‘’e’’ here before.

12.6 Profile, coordinates and moderation

12.6.1 Your profile, during your registration as ACCOMMODATION or ADVERTISER whatever is the category you will subscribe in later on must imperatively contain your real first name and last name, email address and company name if necessary and applicable. Knowing that better the user can contact you, the better it is, any other mention concerning your exact address or phone number are left to your discretion during the constitution of your accommodation under the "Basic Info" tab, where the most important is to add the RIGHT URL LINK leading to the Booking page of your own website or to any other social media page leading to the possibility for the user to enter in contact with you and/or to book your accommodation. Then, it is up to you to exchange with the interested internet user (generally as soon as you will have reached the necessary confidence), all necessary information’s for the fulfilment of the booking of your accommodation and the conditions and finalization of the payment of the accommodation.

12.6.2 We inform you that moderation can be realized by HomeStayHoliday and that in the event of disregard of this condition; your account can be deactivated or deleted without prior notice and without refund of your subscription or any possibility of claim.

12.7 Categories of Accommodations or Advertisers

12.7.1 The various categories of publication for the announcements of accommodations offers on the HomeStayHoliday site are divided into 3 statuses:

- PRIVATE STATUS with the Accommodation categories at the Inhabitant as Private room, Private apartment, Private house, Private Guest house, Private Home Swap, Private Holiday Rental and Private Home sitting/Home sitter

- PUBLIC STATUS with the Professionals Accommodation categories as Professional Bed & Breakfast, Hotel 1* to 5/7*, Camping 0* to 4/5*, Glamping and Professional Holiday Rental

- PROVIDER STATUS Good Addresses, Sponsors and Advertisers

12.7.2 Subscribers to the PRIVATE Status as well as to the PUBLIC Status have due to their subscription and its duration, the possibility of using the site to announce their accommodation, by creating a profile allowing them to insert any useful information’s for the promotion of their accommodation. Each subscription allows the announcement of a single accommodation, without limits of the number of rooms (ex; Deluxe, Standard, etc...) as for example.

12.7.3 Subscribers to the PROVIDER Status GOOD ADDRESSES have due to their subscription and its duration, the possibility of using the site to announce their offer of GOOD ADDRESS nearby an accommodation within 10 km, whatever is its category, and allowing to bright up the stay of a traveller at a host. They can create a profile allowing them to insert an URL Link leading to their website for the promotion of their offers. Each subscription allows the announcement of a single good address.

12.7.4 Subscribers to the PROVIDER Status SPONSOR, have due to their subscription and its duration, the possibility of using the site to announce their company by an advertising banner. This category is opened by auction to all professionals authorized to advertise on our website, excluding all professionals who fall into the category of companies which may not advertise in accordance with our non-exhaustive list mentioned in paragraph j of point 12.3.2 of these Terms. The SPONSOR category allows the sponsoring of a COUNTRY PAGE. Example, a visitor looks for an accommodation in France, by clicking France on the search box of the HOME PAGE of HomeStayHoliday; the page of the country opens with an advertising banner of the Sponsor preceded by the indication «All France pages are sponsored by». Every subscription allows the publication of a single Sponsor banner. Only one banner per country is available.

12.7.5 Subscribers to the PROVIDER Status ADVERTISER have due to their subscription and its duration, the possibility of using the site to announce their proposal, their company by an advertising FOOTER and/or RIGHT SIDE banner. This category is opened to all professionals authorized to advertise on our website excluding all professionals who fall into the category of companies which may not advertise in accordance with our non-exhaustive list mentioned in paragraph j of point 5.3.2 of these Terms. Every subscription allows the publication of a single Advertiser banner.

13. Becoming a HomeStayHoliday Member, Subscriber, Provider or Subscriber provider.

13.1 You become a Member of our website by using our website and/or being registered as either an Accommodation or an Advertiser without having subscribed to any subscription plan. Do not use the account of a third person and do not give your identifiers to other persons.

13.2 You become a Subscriber by using, being registered as ACCOMMODATION and having subscribed to a subscription plan as Accommodation on our website. Do not use the account of a third person and do not give your identifiers to other persons.

13.3 You become a Provider by using, being registered as ADVERTISER and having subscribed to a subscription plan as Sponsor and/or as Advertiser and/or as Good Address on our website. Do not use the account of a third person and do not give your identifiers to other persons.

13.4 You become a Subscriber Provider by using, being registered as ACCOMMODATION and/or ADVERTISER and having subscribed to a subscription plan as Accommodation and/or Sponsor and/or Advertiser and/or as Good Address on our website. Do not use the account of a third person and do not give your identifiers to other persons.

13.5 To announce, you have to register and subscribe to a subscription plan while taking care to provide correct information’s on yourself, your accommodation or your company. After having checked this information’s, you will receive an email of confirmation.

14. Cost

14.1 The USE of the website of the Word Travel Accommodation Ltd HomeStayHoliday.com is FREE for all visitors. As our website is a connecting website with owners posting classified ads offering accommodation, only the posting of accommodation ads, Sponsorships, Advertisements and Good Addresses are subjected to registration and to the payment of a subscription plan for the publication of ads and/or banners and/or Links.

14.2 Our prices or subscription plans gets in EURO (€) that they involve, individuals or professionals . NO OTHER COST NEITHER COMMISSION WILL BE CHARGED TO THE USER HAVING FOUND and BOOK AN ACCOMMODATION OR TO THE USER HAVING ANNOUNCED ACCOMMODATION ON THE SITE, with the exception, where applicable, of exchange fees applied by banking institutions, if the customer pays for his subscription in a currency other than the Euro.

14.3  The prices of HOMESTAYHOLYDAY.com subscription plans are in € (euro).

- The invoicing of a private customer in the EU zone includes the amount of VAT (23%), which is therefore added to the sale price.

- The invoicing of a particular customer OUTSIDE THE E.U. ZONE is not subject to VAT, the payment is therefore exclusive of tax.

- The invoicing of a company in the EU zone, the Company does not pay VAT – principle VAT reverse charge.

- The invoicing of a company in the EU zone, the Company does not pay VAT – principle VAT reverse charge.

14.4 Our subscription plans fees may be changed at anytime for any or all of the indicated categories on our website without any prior notice at the discretion of HomeStayHoliday.

15. Reservation and responsibility

15.1 When a traveller has found an accommodation which suits him, he will be leaded to the direct page of reservation of the accommodation chosen where he will be able to book at the price displayed by the advertiser. The traveller recognizes by booking to have settled directly the rent price and the conditions of the accommodation rental (more possible expenses and taxes) to the host, according to the terms and the conditions of this last one.

15.2 Accommodation reservations (private or professionals) that they are made by any ways of communication between the involved parties remain under the whole responsibility of the internet users using our website for the current reservation. They are consequently committed implementing all the means in order to respect the commitments entered into the ones towards the others.

15.3 The terms, conditions and prices of a reservation are the terms, conditions and prices of reservation of the service provider website as reservations are made directly on the website and/or on any media supports and/or by any means of communication between the service provider and the traveller and not on HomeStayHoliday. The traveller is therefore required to accept the terms, conditions and prices established by the service provider before making any reservation. The service provider is solely responsible for the veracity of the information contained in its announced and in its general conditions. It is up to the traveller to verify and resolve any ambiguity concerning this information, by any means at his disposal and before any reservation.

15.4 HomeStayHoliday cannot be besides in no one case held as responsible, before, during or after a reservation made by a traveller that it is through written or voices discussions with the host or that it is through the online booking system of the website and/or any media supports of the host.

15.5 Once the deposit or the full price requested by the host has been paid by any means agreed between the traveller and the host, no refund or claim can be requested from HomeStayHoliday. Only the announcer is required to make any refund, if applicable, to the traveller according to the host's general conditions and / or the agreement he has made with the traveller, by any means at their disposal and according to the circumstances of the claim.

15.6 Once the deposit or the full price requested by the host has been paid by any means agreed between the traveller and the host, the stakeholders have to honour their commitments. It means that the host has to supply accommodation to the traveller according the reservation coordinates made by the traveller and at the conditions indicated in the host general conditions and, for the traveller, to present himself at the accommodation according the reservation made. HomeStayHoliday will never intervene between travellers and hosts regarding conditions and obligations of the ones towards others, but may have a role of advice, if needed, without engaging its responsibility in any means.

15.7 The hosts and the travellers have to agree on details of the accommodation, namely the arrival date and time, the possible cares to be provided and/or transfers, as well as the agreements of regulations (none exhaustive list). Except the details mentioned previously, the conditions of the individual commitment between the traveller and the host, are established in their legal context without any intervention from HomeStayHoliday.

15.8 Announcer undertake to update their announce and their schedule on their own website and/or on all of their media supports as soon as possible regardless of availability which are no longer available for rental.

15.9 HomeStayHoliday advises you to keep any written trace of the exchanges until the final achievement of a stay and even beyond.

15.10 The traveller is the only responsible for the possible damages caused from his part or persons accompanying or visiting him in the accommodation during his stay. HomeStayHoliday cannot be held as responsible in any case.

15.11 On the HomeStayHoliday website, accommodation hosts must be authorized to officially sign a contract or having obtained the agreement of their tutor or their representative.

16. Subscription duration and termination

The registration of the visitors on our website can be made for an indefinite period or in any event till their profile is deleted. Subscriptions on our website can be made monthly, quarterly or yearly and remain valid as of the registration date paid on the HomeStayHoliday website and/or in any event till their profile of the subscriber is deleted.The announces and advertisements are renewable as often as you wish according to your choice of period. Each subscriber will be informed individually seven days and one day before the expiration date of the subscription, in order to invite him to renew his subscription.

17. Measures for travellers

17.1 The travellers are fully responsible for preparations relative to their journeys and to their stays, transport tickets, passport, visa, vaccines and all others necessary documents even if they are not mentioned here, according to the country the traveller has book an accommodation.

17.2 HomeStayHoliday invites all travellers to inquire directly with concerned countries’ embassies or consulates they want to visit and to verify all necessary information regarding their visit in a country whatever it is. HomeStayHoliday cannot in any manners be held as responsible for any mishap due to a bad preparation of journey or stay or reservation.

18. Cancellation

18.1 Members, Subscribers, Providers and Subscriber Providers may delete their profile, accommodation listings, advertisement banners, addresses links and sponsorship banners at any time whatever are the subscription plans, by deleting their profile on the HomeStayHoliday website. To do so, you will need to send us an email at contact@homestayholiday.com stating your wish to remove your profile from our website and we will do it for you as soon as possible. HomeStayHoliday however draws your attention to the fact that the deletion of your profile will therefore delete all your accommodation listings, advertisements banners, good addresses links or sponsorship banners still online, pending or expired, without giving you any right to be refunded or to claim of all or part of your subscription plans, whatever it may be.

18.2 Members, Subscribers, Providers and Subscriber Providers may not cancel their accommodation listings, advertisements banners, good addresses links and sponsorship banners by themselves in their admin dashboard on the HomeStayHoliday website without deleting their profile but they can delete only new created as far they are not paid.

18.1 Once your subscription is submitted and paid for on our website regardless of the subscription plan to be paid, HomeStayHoliday cannot refund you in the event of cancellation due to death or illness of the user or any other cause beyond the control of HomeStayHoliday.

19. Terms of payment

19.1 On HomeStayHoliday website, you can pay your accommodation subscription or your advertisement by credit/debit card directly to the Word Travel Accommodation Ltd company account, through our partner service provider STRIPE, by PayPal payments or by Bank Transfer on the Word Travel Accommodation Ltd company bank account. The details of the bank account will be sent to you by email at the time of your choice of payment if your choice is payment by bank account.

19.2 The payment of SPONSORSHIP subscriptions have to be done IMPERATIVELY by credit/debit card through our partner service provider STRIPE as the sums of the auction offers will be kept on HOLD by STRIPE - 7 (seven) - days from the day of the auction made by the subscriber till the completion of the auctions dates. The dates of auctions are monthly from 20th till 25th.

20. Price modifications

HomeStayHoliday reserves the right to modify the prices of the subscription plans indicated on the website at the discretion of the Word Travel Accommodation Ltd Company without any prior advice whatever the categories of accommodation or kind of advertising.

21. Insurance

21.1 Travellers: HomeStayHoliday recommends to travellers to subscribe to all necessary travel insurance (repatriation, accident, theft, loss, cancellation, etc.). HomeStayHoliday cannot be held responsible for any consequences in case of lack and/or defect of insurance subscription. 

21.2 Hosts: HomeStayHoliday recommends to hosts to have in place insurance against theft, property damages caused by a third party, and generally any insurance coverage required for your private or professional host status. HomeStayHoliday recommends you nevertheless to inquire with your usual insurer and cannot be held responsible for any consequences in case of lack and/or defect of insurance subscription.

22. Minors (under age)

22.1 Warning: every internet user recognizes having the knowledge that internet allows the connection to sites which the contents are harmful and highly inadvisable for minors (under age) (information and photographs of violent nature, pornographic, etc.). You thus make a commitment to watch and to restrict your internet access to the minors (under age).

22.2 According to countries, minors (under age) cannot be authorized to leave their residence territory alone without a written authorization of the parents or the tutors. HomeStayHoliday thus recommends you to inquire with proper authorities and cannot be held as responsible in case of problem regarding this point.

22.3 The minors (under age) are not authorized to drink alcohol, except when the legislation of the country of destination you visit may authorize it. HomeStayHoliday cannot be held as responsible in case of problem regarding this point.

22.4 All other points of laws concerning minors (under age) (going out alone in the evening, etc.) are governed by the legislation of the country of destination, and it is up to the parents or tutors to inquire about it and to conform to it. HomeStayHoliday.com cannot be held responsible for any failure or negligence with this point.

23. Case of dispute and Jurisdiction

23.1 Only the law of the Republic of Ireland is applicable to this present website and for its present terms of use and legal notice. In case of dispute, only the courts of Dublin will be competent.

23.2 HomeStayHoliday does not claim in any case that the activities or the projects of the members or subscribers or providers or subscriber providers are in conformity with the applicable legislations according to the countries of which they are native from.

23.3 The access to the HomeStayHoliday website, as well as the provision of the various types of accommodation announced on the site, can turn out against the laws in certain countries, or impose certain specifics regulations appropriate for these countries. You are the only responsible for conforming to the current laws of your jurisdiction.

24. Responsibility

24.1 HomeStayHoliday does not write any announcements and is not the author of any photographs relating to accommodation announcements or advertisements (unless otherwise indicated). HomeStayHoliday cannot be thus held for responsible for the contents or for the lack of concordance of information inserted in the forms spread on the site, as far as these announcements or messages are written by third parties under their own and whole responsibility. Consequently, it is up to the internet user to take and to use the information spread on the HomeStayHoliday website with the necessary caution and naturally to proceed to any check under its own initiative and responsibility. HomeStayHoliday will not be held as responsible in case of damage or conflicts which could occur between engaged parties, neither of any fraud on an announcement, nor of false announcement, addition or omission tending to the fraud, or announcement presenting an illicit character and not answering to the legal requirements. All these elements are bounds to the exclusive responsibility of the announcer.

24.2 Responsibility of the data transmission: the internet user guarantees that all information passed on to the Word Travel Accommodation Ltd (HomeStayHoliday.com) is exact. It involves quite particularly the contents of files and passed on photos. The subscribed internet user commits, particularly but not exclusively to the fact that the real appearances of the contracting persons as well as places of accommodation are clearly visible on photos while reflecting the strict reality. Any failure with this rule will automatically involve the deletion of the concerned profile and immediate termination of collaboration with the concerned internet user by HomeStayHoliday, and this, without refund of the subscription or possibility of claim.

24.3 Accommodations and services offered on the website HomeStayHoliday.com are supplied by third parties subscribers. Consequently, HomeStayHoliday.com does not offer or provide its own accommodation or its own services, with the exception of the connecting service between travellers and hosts. HomeStayHoliday.com cannot be thus considered responsible for the inaccuracy of the information and photographs supplied by hosts as by travellers and other providers. Moreover, the responsibility of HomeStayHoliday.com cannot be thus committed in any way in case the host, traveller or other provider does not fulfil the mission which is stipulated by the terms of use of the host or if the traveller is not satisfied by the accommodation and services provided by the host or other provider and this whatever the reason.

24.4 The prices indicated on ads are in € (Euros) at the exchange rate of the day of the online posting of the ads according to the prices announced on the Subscriber Accommodation website and are indicated as an indication under the full responsibility of the Subscribers.

24.5 Subscriber Accommodation are solely responsible for their offers, their rates and their bookings schedule. 

24.6 Reservations of Accommodation are paid directly on the Subscriber Accommodation website at the rates indicated on their own website, which are generally in their local currency. and controled under their full responsability. It is their INDIVIDUAL responsibility to adjust the prices indicated on HomeStayHoliday and to correlate them with those indicated on their own website.

25. Interpretation

In the case or one or several clauses of the present terms of use of the website and its legal notice, would be declared invalid or null by a competent court, the nullity of the aforementioned clause would not affect the validity of the others clauses contained in the present Terms of Use and Privacy Policy, who will remain in force. The titles do not have any legal or contractual incidence.
